Article 2 — Purpose and Scope

These Terms and Conditions of Sale govern the sale of products through the website www.armorial.fr to consumers purchasing for personal, non-business purposes.

They define the respective rights and obligations of ARMORIAL and its customers in connection with orders placed online.

By placing an order, the customer acknowledges having read and accepted these Terms and Conditions of Sale.

The Terms and Conditions applicable to an order are those in force on the date the order is confirmed.

Orders placed by business customers and bespoke products supplied on the basis of a quotation may be subject to specific contractual terms.

Article 3 — Products

ARMORIAL offers a range of products including stationery, notebooks, cards, accessories and gifts.

The essential characteristics and prices of the products are provided on their respective product pages.

ARMORIAL takes great care to ensure that its products are accurately presented. Photographs are provided for illustrative purposes. Slight variations in colour or texture may occur depending on screen settings or the natural characteristics of the materials used, without affecting the customer’s statutory rights.

All products are offered subject to availability.

Personalisation, engraving and bespoke manufacturing services are available exclusively upon quotation and are subject to specific terms communicated when the quotation is issued.

Article 4 — Orders

Customers select the products they wish to purchase and add them to their shopping basket.

Before confirming an order, customers can review its details, including the total price and delivery charges, and correct any errors.

Final confirmation of an order constitutes acceptance of these Terms and Conditions of Sale and express acknowledgement of the obligation to pay.

An order confirmation email summarising the essential details of the purchase is sent to the customer once the order has been validated.

ARMORIAL reserves the right to refuse an order for legitimate reasons, including payment failure or suspected fraud.

Should a product become unavailable after an order has been placed, the customer will be informed as soon as possible and may obtain a refund for the unavailable product.

Article 5 — Prices

All prices displayed on the website are expressed in euros (€) and include all applicable taxes (VAT included).

Delivery charges are indicated separately before the order is finally confirmed.

ARMORIAL reserves the right to change its prices at any time. Products will nevertheless be invoiced at the prices in force when the order is confirmed.

For deliveries to the United Kingdom or other destinations subject to customs formalities, import duties, local taxes or customs clearance charges may apply. Where such charges are not included in the order total, they are payable by the recipient, in accordance with the information provided before purchase.

Article 6 — Payment

Payment for orders is accepted exclusively by credit or debit card through the secure payment system available on the website.

Full payment is required when placing an order.

If payment is declined by the card issuer or banking institution, the order cannot be confirmed.

ARMORIAL does not retain customers’ complete bank card details, as these are processed by a secure payment service provider.

Ownership of the products remains with ARMORIAL until payment has been received in full.

Article 7 — Delivery

7.1 Delivery Destinations

ARMORIAL delivers its products to France, European Union countries and the United Kingdom, subject to the destinations available during checkout.

Collection of online orders from the shop is not available.

7.2 Delivery Times

For products in stock, the usual estimated delivery time is 4 to 5 working days from order confirmation.

Delivery times may vary depending on the destination country, transport conditions or any applicable customs formalities.

The applicable delivery date or estimated delivery period is communicated before the order is finally confirmed.

Where no specific delivery period has been agreed, delivery will take place without undue delay and no later than thirty days after the contract is concluded.

7.3 Delivery Delays

If delivery does not take place within the agreed period, the customer may request that ARMORIAL deliver the products within an additional reasonable period.

If delivery is not completed within this additional period, the customer may terminate the contract in accordance with the applicable provisions of the French Consumer Code.

The customer may terminate the contract immediately in circumstances provided for by law, particularly where the agreed delivery date was an essential condition of the contract.

Where the contract is validly terminated, all sums paid will be refunded within the statutory time limits.

7.4 Receipt of Products

Customers are encouraged to inspect the condition of the products upon receipt and to report any issues to customer service.

Failure to carry out such an inspection does not affect the customer’s statutory rights.

The risk of loss or damage to the products passes to the customer when the customer, or a third party designated by them other than the carrier, takes physical possession of the products, except where otherwise provided by law.

Article 8 — Right of Withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, customers have 14 days from receipt of their order to exercise their right of withdrawal, without having to provide a reason.

Where several products from the same order are delivered separately, this period begins upon receipt of the last product.

To exercise the right of withdrawal, customers must notify ARMORIAL of their decision by means of a clear statement, including:

  • By email to info@armorial.fr;
  • By post to ARMORIAL FRANCE, 101 avenue Victor Hugo, 75016 Paris, France;
  • By using the model withdrawal form provided in the appendix to these Terms and Conditions;
  • By using the online withdrawal facility available directly on the website.

The withdrawal request must be submitted before the end of the statutory withdrawal period.

Withdrawal requests submitted online will be acknowledged on a durable medium, indicating in particular the date and time of submission.

Simply returning a product without first notifying ARMORIAL of the decision to withdraw does not constitute a valid exercise of this right.

Article 9 — Exceptions to the Right of Withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to goods made to the consumer’s specifications or which are clearly personalised.

Personalised products offered by ARMORIAL are available exclusively on the basis of a prior quotation.

The specific terms applicable to these products, particularly regarding withdrawal rights, are communicated when the relevant contract is concluded.

Exclusion of the right of withdrawal does not affect the consumer’s statutory rights relating to product conformity and hidden defects.

Article 10 — Returns and Refunds

10.1 Return Conditions

After exercising their right of withdrawal, customers have a further 14 days to return the products concerned.

Products must be appropriately packaged and protected to prevent damage during transport.

Customers may examine and handle products to the extent necessary to establish their nature, characteristics and proper functioning.

Customers may be held responsible for any reduction in value resulting from handling beyond what is necessary for this purpose.

10.2 Returns Address

All returns must be sent to:

ARMORIAL FRANCE
Returns Department
101 avenue Victor Hugo
75016 Paris
France

Email: info@armorial.fr

10.3 Return Shipping Costs

Where a customer exercises their right of withdrawal because they have changed their mind, the direct cost of returning the products is borne by the customer.

However, return costs associated with defective or non-conforming products will be covered in accordance with the applicable statutory guarantees.

10.4 Refunds

Where a customer validly exercises their right of withdrawal, ARMORIAL will refund all payments received, including the original delivery charges corresponding to the standard delivery option offered.

Any additional costs resulting from the customer’s choice of a more expensive delivery method will not be refunded.

Refunds will be issued no later than 14 days after ARMORIAL has been informed of the customer’s decision to withdraw.

ARMORIAL may withhold the refund until the products have been received or until the customer has provided evidence of having returned them, whichever occurs first.

Refunds will be made using the same payment method as the original transaction, unless the customer expressly agrees otherwise, and without any additional charges.

Article 11 — Statutory Guarantees

All products sold by ARMORIAL are covered by the statutory guarantees provided under the French Consumer Code and the French Civil Code, independently of any additional commercial warranty that may be offered.

11.1 Statutory Guarantee of Conformity

In accordance with Articles L.217-3 et seq. of the French Consumer Code, consumers benefit from a statutory guarantee of conformity for a period of two years from delivery of the product.

During this period, consumers may request that a product presenting a lack of conformity be brought into conformity without having to establish when the defect first appeared.

Products may be brought into conformity through repair or replacement, subject to the conditions provided by law.

Repair or replacement must be carried out free of charge, without significant inconvenience to the consumer and within a maximum period of thirty days following the request.

Any repair carried out under this guarantee results in a six-month extension of the original guarantee period.

Where the consumer requests a repair but the seller instead replaces the product, a new two-year guarantee period begins from delivery of the replacement product.

Where a product includes digital content or a digital service supplied continuously for a contractual period exceeding two years, the guarantee applies to that content or service throughout the agreed supply period.

Where applicable, the seller must also provide the updates necessary to maintain the product’s conformity.

The consumer may obtain a price reduction or terminate the sales contract, particularly where:

  • ARMORIAL refuses to repair or replace the product;
  • The product is not brought into conformity within the statutory thirty-day period;
  • Repair or replacement causes significant inconvenience to the consumer;
  • The defect persists despite an attempt to bring the product into conformity.

Where the lack of conformity is sufficiently serious, the consumer may request an immediate price reduction or termination of the contract without first having to request repair or replacement.

However, termination of the contract is not available where the defect is minor.

Any period during which the product is unavailable due to repair or replacement suspends the remaining guarantee period until the product has been returned in conformity.

A seller acting in bad faith and obstructing the application of the statutory guarantee of conformity may be subject to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover, in accordance with Article L.241-5 of the French Consumer Code.

11.2 Guarantee Against Hidden Defects

Consumers also benefit from the statutory guarantee against hidden defects, in accordance with Articles 1641 to 1649 of the French Civil Code.

This guarantee applies where a defect that was not apparent at the time of purchase renders the product unfit for its intended purpose or substantially reduces its usefulness.

Consumers have two years from the discovery of the defect to bring a claim.

Under the conditions provided by law, consumers may choose either to return the product and obtain a refund of the purchase price or to keep the product and receive a partial refund.

11.3 Making a Guarantee Claim

For any request relating to statutory guarantees, customers may contact ARMORIAL:

ARMORIAL FRANCE
101 avenue Victor Hugo
75016 Paris
France

Email: info@armorial.fr
Telephone: +33 (0)1 42 60 20 08

Statutory guarantees apply at no cost to the consumer, in accordance with the mandatory provisions of the French Consumer Code.

Article 12 — Liability

ARMORIAL is responsible for the proper performance of its contractual obligations in accordance with applicable legislation.

ARMORIAL shall not be held liable where failure to perform its obligations results from the customer’s own actions, the unforeseeable and unavoidable actions of a third party to the contract, or an event of force majeure.

Nothing in these Terms and Conditions excludes or restricts the statutory guarantees or mandatory rights afforded to consumers.

Article 13 — Intellectual Property

All elements appearing on www.armorial.fr, including text, photographs, images, logos, trademarks and graphic designs, are protected by applicable intellectual property laws.

Any reproduction, distribution, representation or exploitation without prior authorisation is prohibited, subject to exceptions provided by law.

Article 14 — Personal Data

ARMORIAL collects personal data necessary for processing orders, payments, deliveries and customer relations.

Such processing is carried out in accordance with the General Data Protection Regulation (GDPR) and applicable French legislation.

Customers have the right to access, rectify and erase their personal data and, where provided by law, to object to or restrict its processing.

These rights may be exercised by contacting info@armorial.fr.

Further information concerning the processing and retention of personal data is provided in the website’s Privacy Policy.

Article 15 — Complaints and Consumer Mediation

For any complaint relating to an order, customers may contact ARMORIAL at:

info@armorial.fr

ARMORIAL endeavours to resolve any dispute amicably.

In accordance with Articles L.612-1 et seq. of the French Consumer Code, consumers have the right to use a consumer mediation service free of charge to seek an amicable resolution of a dispute, provided they have first submitted a written complaint to the seller and have not obtained a satisfactory resolution.

ARMORIAL undertakes to enable consumers to exercise this right in accordance with applicable legislation.

Participation in mediation is optional for consumers and does not affect their right to bring proceedings before the competent courts.

Article 16 — Force Majeure

ARMORIAL shall not be held liable for any failure to fulfil its contractual obligations resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code.

The consequences of such an event for contractual obligations shall be governed by the applicable legal provisions.

Article 17 — Governing Law and Dispute Resolution

These Terms and Conditions of Sale are governed by French law.

This provision does not deprive consumers residing in another country of any mandatory protections to which they may be entitled under the laws applicable in their country of habitual residence.

In the event of a dispute that cannot be resolved amicably, the competent courts shall be determined in accordance with applicable jurisdiction rules, without prejudice to consumers’ statutory rights.
